This is evidenced by the court's decision dated February 24.
In 2023, the Lviv Regional State Administration approved the technical documentation for land spanning 293 hectares within the Davydov village council of the Lviv district. The right of permanent use is granted to the State Enterprise "Forests of Ukraine."
According to the prosecution, as a result of these actions, lands designated for the military town covering 3.3 hectares were included in the land parcel with the cadastral number 4623681200:08:000:0437, which led to unlawful interference and a violation of the state's right to freely use the land.
At the same time, the State Enterprise "Forests of Ukraine" asserts that the disputed land parcel has belonged to the state forest fund of the Vynnyky Forestry since 1939. During Soviet times, state forest fund lands were occasionally allocated for military units without being withdrawn from permanent users, which had strategic camouflage significance.
Furthermore, in 2023, the inventory of the lands of the state forest fund of the Vynnyky Forestry within the Davydov village council was completed, and the respective cadastral numbers were assigned to the land parcels. Therefore, the prosecution's claims are unfounded.
The court concluded that the allocation of land for the permanent use of the State Enterprise "Forests of Ukraine" was lawful.
In the court session, the prosecution was represented by Yu.A. Havrylov, with T.P. Kaptsova serving as the judge.
Recall:
The prosecution was unable to reclaim a 0.5-hectare land parcel from the "Rokitne Forestry" branch of the state specialized enterprise "Forests of Ukraine," which is currently utilized by individual entrepreneur Vasyl Petrovskyi.
