The investigating judge of the Shevchenkivskyi District Court of Kyiv granted the employees of the Bureau of Economic Security (BEB) access to information about Ukrainian citizens registered on the OnlyFans platform. The corresponding decision was made by the court on September 20.
According to the ruling, BEB detectives were given temporary access to data about all Ukrainian OnlyFans users, including their last name, first name, patronymic, date of birth, taxpayer identification number, and other information about creators of paid content held by the State Tax Service (STS).
Upon receiving this data, BEB employees began conducting searches at the homes of OnlyFans models as part of a criminal case under Part 3 of Article 212 of the Criminal Code of Ukraine (tax evasion in particularly large amounts).
"Last week, BEB began visiting those who have declared and paid their income taxes. After receiving a list from the STS, they are now working with registered models who have no relation to the case opened in July 2024," she reported.
Lawyer Lesya Mihaylenko from the company "You Have the Right" explained that searches commenced with those who had already registered as individual entrepreneurs (IE), submitted declarations, and paid taxes. Earlier this fall, the head of the tax committee of the Verkhovna Rada, Daniil Hetmantsev, stated that the STS obtained information about Ukrainian OnlyFans users and their incomes. Following this, many began receiving notifications demanding tax payments. As a result, most models voluntarily registered as IEs, declared their incomes, and paid taxes.
However, the transfer of this data to the BEB has led to additional pressure on content creators.
The situation has prompted a response from members of parliament. Deputy head of the tax committee of the Verkhovna Rada, Yaroslav Zheleznyak, deemed it unacceptable to simultaneously demand tax payments for content creation while maintaining criminal liability for its production.
Hetmantsev also emphasized that failing to pay taxes on time is not grounds for criminal prosecution. He added that the pressure on content creators contradicts the logic of society, which, on one hand, condemns their activities, while on the other, benefits from the results of their work.
According to him, in 2024, OnlyFans models declared incomes amounting to 305.4 million UAH and paid 59 million UAH in taxes and military fees.
