Kolomoisky is once again attempting to challenge the nationalization of PrivatBank.

Businessman Igor Kolomoisky has appealed to the Constitutional Court of Ukraine (CCU) demanding that certain provisions of law No. 590-IX ("anti-Kolomoisky" law) be declared unconstitutional. Initially, the court refused to open proceedings; however, due to disagreements among the judges, the final decision will now be made by the Second Senate of the CCU. This was reported by the bank's press service.

Kolomoisky claims that the law deprives him of his property rights, limits judicial protection, and violates the principle of equality of parties in court. In his view, these norms contradict the Constitution of Ukraine, which is why he demands their invalidation.

PrivatBank reminded that the former owner has repeatedly tried to challenge the nationalization of the bank. In November 2024, the Cassation Economic Court as part of the Supreme Court definitively confirmed the impossibility of returning PrivatBank to the former owners, closing the relevant proceedings. Following this, Kolomoisky decided to appeal to the Constitutional Court.

Additionally, on Wednesday, February 26, the Cassation Administrative Court as part of the Supreme Court is considering another complaint from the businessman related to the challenge of nationalization. The defendants in this case are the Cabinet of Ministers, the National Bank of Ukraine, the Ministry of Finance, the Deposit Guarantee Fund, and PrivatBank.

Reminder:

  • The legal proceedings regarding the nationalization of PrivatBank have been ongoing since 2017.
  • In 2019, the Kyiv District Administrative Court recognized the nationalization as illegal; however, this decision was later overturned.
  • In November 2023, the Sixth Appellate Administrative Court granted the request of PrivatBank and state authorities, finally closing the case in administrative courts.
