In Ukraine, a nationwide mobilization is ongoing, and martial law has been implemented. During this period, men aged 18 to 60 who are subject to conscription receive summonses. Lawyer Nikolai Oniskovets, managing partner at the law firm "AKT" and head of military law practice, informed "UNIAN" about the consequences awaiting those who ignore these summonses.
According to Article 210-1 of the Code of Ukraine on Administrative Offenses, there are administrative penalties for violating mobilization legislation. Ignoring a summons during martial law can result in a fine ranging from 17,000 to 25,500 hryvnias. During wartime, representatives of territorial recruitment centers (TRC) are not required to draft a protocol—they can issue a ruling in absentia, which must be sent to the violator.
A citizen has the option to either pay the fine or contest the ruling. If the fine is not paid or challenged, the case is forwarded to the enforcement service, which can impose a freeze on bank accounts or property, Oniskovets reminded.
In addition to fines, there are other enforcement measures for ignoring a summons as outlined in Article 27 of the Law of Ukraine "On Mobilization Preparation and Mobilization," the lawyer added. If a citizen fails to appear as summoned, the head of the TRC may contact the police to detain the individual and bring them to the recruitment center. If the police are unable to detain the violator, they will provide a written response stating that detainment is not possible.
The TRC has the right to send a demand, which is also considered a delivered document even if the individual does not receive or refuses the letter.
If the individual still fails to fulfill their obligation after this, the TRC may petition the court to temporarily restrict the violator's right to operate a vehicle.
It is worth noting that on October 18, lawyer Dmitry Kushnarenko stated that it has become impossible in Ukraine to prove that a conscripts improperly received a summons.
On October 20, MP from "Servant of the People" Alexander Fedienko announced that users and administrators of Telegram channels who report on the workplaces of TRC and police employees will be held accountable.
