Employees' work correspondence will be accessible for viewing: what's changing in the Labor Code (photo).

The new labor code project expands the employer's right to monitor employees' work-related correspondence. However, it remains unclear how the process of respecting employees' privacy and personal life will be regulated.

The Ministry of Economy of Ukraine proposes in the draft of the new Labor Code for 2025 to allow employers to monitor employees' work correspondence. This is mentioned in the text of the bill developed by the ministry.

The document includes Article 31, titled "Monitoring Employee Work Correspondence and Other Data." According to its text, employers are now granted the right to view work-related correspondence and documents utilized during job performance.

At the same time, the text of the same article states that such actions by the employer represent the "extreme form of employer control" and may only be applied under the condition of "the impossibility of using alternative methods of monitoring the employee's fulfillment of labor duties."

"The employer must inform the employee about the introduction of monitoring and justify the objective necessity for its implementation," as indicated in the third paragraph of this article.

The final point of the article specifies that the employer is not allowed to violate the employee's right to personal and family life through the implementation of such monitoring.

It is worth noting that it was previously reported that employees could be dismissed for violating "behavioral rules". The Verkhovna Rada overcame the veto of the President of Ukraine and approved the draft law No. 7731, considering his suggestions, which had earlier faced criticism due to a clause requiring employees to report "connections" with individuals in occupied territories.

Additionally, it became known that there will be another reason for dismissing employees in Ukraine. The disclosure of commercial secrets may become grounds for termination. Previously, employees faced only a reprimand for violating this rule.
