This is evidenced by the court decision dated January 15.
In 2007, the Kyiv City State Administration (KCSA) granted the developer "Melvix" permission to design and construct a public, commercial-office, hotel complex, and high-comfort apartments with underground and above-ground parking, along with landscaping, covering a total area of 290,000 square meters at the intersection of Borshchahivska Street and Vozdukhoflotsky Avenue in the Shevchenko district of Kyiv.
At that time, the Main Department of Economics and Investments of the KCSA and "Melvix" signed a participation agreement for the creation of social and engineering-transport infrastructure in the city of Kyiv.
The agreement stipulated that in the event of an increase in the overall area of the project or changes to other characteristics, the amount of the participation fee should also increase.
In 2016, the Kyiv City Council granted "Melvix" permission to change the land use of a 1.66-hectare plot (cadastral number 8000000000:88:217:0002) and allowed the developer to use this plot for the construction, operation, and maintenance of a public, commercial-office, residential, and hotel complex.
The Kyiv authorities required "Melvix" to enter into a new participation agreement. The developer ignored this requirement. Subsequently, the prosecutor's office filed a lawsuit to recover 69.34 million UAH of unjustly retained funds from the developer. The court granted the claim.
"The payment of participation fees related to the construction of multi-apartment residential buildings is a direct obligation of developers," the prosecutor's office noted in its statement regarding the court's decision.
Currently, the owner and director of LLC "Melvix" is Alexander Stanovsky.
