This is evidenced by the decision of the Economic Court of Kyiv dated January 13.
In 1997, the Cabinet of Ministers decided to place the Ministry of Energy in the building located at 34 Khreshchatyk Street in Kyiv. The Ministry of Energy leased the third and seventh floors of this building to the Ukrainian Union of Industrialists and Entrepreneurs (UUIE).
In October 2023, the Cabinet of Ministers revoked the Ministry of Energy's management of the seven-story building at 34 Khreshchatyk Street and transferred it to the Secretariat of the Cabinet.
In August 2024, the government decided to house the Ministry of Veterans Affairs in this building, particularly in the spaces previously used by the UUIE.
The UUIE filed a lawsuit demanding that the Secretariat of the Cabinet provide access to the third and seventh-floor premises and not obstruct their use during the court proceedings.
The court established that the dispute arose due to the UUIE's claims regarding the legal grounds for acquiring the premises through adverse possession.
Among the arguments presented by the organization is that the UUIE has long owned and used the premises, treating them as an owner and conducting repairs. Additionally, the organization claimed non-titular possession of the premises (actual possession that does not rely on any legal basis for holding someone else's property - ed.).
At the same time, the court noted that the premises are state property, a fact that the UUIE does not dispute. Following a series of Cabinet decisions in 2024, the organization lost its legal grounds for using, in particular, the third-floor premises.
Regarding the arguments that the UUIE owned and treated the premises as an owner, the court deemed them unsubstantiated. Moreover, the court concluded that the organization did not actually claim ownership of the premises but was only interested in using them. This is supported by the UUIE's attempt to enter into a lease agreement with the State Property Fund concerning the real estate in the building at 34 Khreshchatyk Street.
As a result, the court rejected the lawsuit.
The president of the UUIE has long been Anatoliy Kinakh. He served as the Prime Minister of Ukraine from 2001 to 2002.
