I returned from Sochi after my brother was mobilized; border guards apprehended a soldier who was trying to escape.

A serviceman who had previously deserted and fled to Romania has returned to Ukraine. He has chosen to defend his country alongside a mobilized relative.

Border guards from the Chernivtsi border detachment at the "Porubne" checkpoint apprehended a man who illegally crossed the state border from Romania into Ukraine, circumventing the checkpoints. This was reported by the State Border Guard Service of Ukraine (SBGSU).

It turned out that the detained individual was a resident of Vinnytsia region and a serviceman in one of the units of the Armed Forces of Ukraine.

The man explained that at the beginning of October, he had deserted his post and crossed the state border unlawfully, ending up in neighboring Romania.

However, when he learned that his brother had been mobilized into the army, he decided to return, seizing the opportunity to avoid punishment for desertion, as stipulated by Article 401 of the Criminal Code of Ukraine, in order to defend the country together.

The border guards prepared materials regarding the administrative offense committed by the detained serviceman.

It is worth noting that many military personnel who have deserted their units are turning to the 3rd Separate Assault Brigade of the Armed Forces of Ukraine. The deputy commander of the 3rd SABr, Major Maksym Zhorin, emphasized that the unit can accept a serviceman who left for valid reasons due to poor command, but those who abandoned their positions or endangered their comrades will not be welcomed back.

Lawyer Roman Likhachev stated that servicemen can reapply to return if the reasons for their desertion have not been resolved. For instance, this can happen due to bureaucratic issues or the inability to demobilize legally.
